Liability Waivers and Toddler Birthday Parties - Toddlers - Families ...

birthday If your toddler participates in any organized activity, such as day care or baby fun activity centers, you are probably used to signing a waiver before your child can participate. After all, minor bumps and bruises can be a part of a child's life, and most healthy toddlers have a banged knee at one point or another.

But what if you have to sign a liability waiver just for your toddler to attend a friend's birthday party in someone's home? You have to agree to hold the host family harmless if something should happen to your little one.

Why a liability waiver? Will the party include live lions or toddler-eating snakes. The idea of liability waivers and toddlers makes me picture a hostile living room where the birthday balloons are filled with poison gas and the toddlers have to navigate barbed wire just to get to the birthday cake.

Unfortunately, many "normal" families are now including liability waivers in with their birthday party invitations. It can turn a fun and friendly interaction to a legal contract that is just, well, weird.

So how do you react if you get one and don't want to sign it? Perhaps ask the host if there are specific dangers that the family is concerned about. Maybe there is a pool in the home or peanuts being served. Whatever the case, toddlers shouldn't be left alone unsupervised at any birthday party anyway. Parents should be welcome and encouraged to stay for as long as their child will be there. Ultimately, parents should be responsible for their own children anyway.

If you are presented with a liability waiver for a home-based birthday party, you don't have to sign it of course. I would imagine that most hosts would back down. If not, you might want to introduce your toddler to some new little friends.

An international team of researchers led by the University of Melbourne has used new technology to fast track the discovery of a breast cancer risk gene and could assist in the discovery of other cancer genes.

Professor Melissa Southey of the Genetic Epidemiology Laboratory, Department of Pathology at the University of Melbourne, who led the study, said it was a significant discovery and the first breast cancer risk gene to be discovered using the latest genetic sequencing technology.

"The mutations in the newly identified gene XRCC2, although rare, explain another proportion of breast cancers that run in families where there is no known genetic cause and that particularly occur at an early age," she said.

"We identified this gene quite quickly using genetic technology called massively parallel sequencing, which enables sequencing of large amounts of human DNA at high speed.'

"Due to these results and our methodology we believe that further risk genes will be identified at a faster rate than before and potentially for other cancers such as colorectal and prostate cancers," she said.

Professor Southey said the discovery could help manage the risk of breast cancer for families with a strong history of the disease and no known genetic cause.

"This discovery will assist some families to determine individual risk and which family members are at high risk of contracting the disease," Professor Southey said.

"Unaffected relatives of people with a mutation in this gene could also be offered predictive testing, subsequent genetic counselling and ongoing clinical management on the basis of their mutation status.'

"People whose breast cancer is associated with XRCC2 mutations could also benefit from specific treatments that target the genetic fault," she said.

Currently, only about 30 per cent of the familial risk for breast cancer has been explained, leaving the substantial majority still unaccounted for.

"Research indicates that no single gene is likely to account for a large proportion of the remaining unexplained genetic susceptibility to breast cancer," Professor Southey said.

"Although mutations in XRCC2 are rare, it is most likely that the remaining unknown breast cancer susceptibility genes will account for similar small proportions of the disease."

Initially, using massively parallel sequencing, researchers identified XRCC2 mutations in two families (in Melbourne and the Netherlands). This was followed by a larger series of studies using DNA from blood samples of 689 families with multiple members affected by breast cancer, and from 1308 women who were affected at an early age by breast cancer and recruited from the general population, as well as 1120 controls.

More XRCC2 mutations were detected in the breast cancer cases but not in the controls. These additional studies were conducted in Melbourne and at the International Agency for Research on Cancer (IARC) in France.

Co-first author Dr Daniel Park of the University's Department of Pathology (with Dr Fabienne Lesueur of IARC) said the study demonstrated the power of massively parallel sequencing for discovering susceptibility genes for common, complex diseases like breast cancer.

"Our study approach could be applied to many other common, complex diseases with components of unexplained heritability, such as colorectal and prostate cancers," he said.

Professor Southey oversaw this work with two long-standing collaborators and experts in the field of breast cancer genetics, Associate Professor Sean Tavtigian and Professor David Goldgar at the University of Utah.

Trying to time the market is a fool?s game. Instead, here is a time tested (yet underappreciated) method for riding out volatile markets.

On Sunday, I was on a plane traveling across the country. With lots of time on my hands, I did something I haven?t done for years. I read every section of the Sunday New York Times. It was a great way to spend the day as the hours on the plane just flew by.

One article, in particular grabbed me. Paul Lim discussed whether or not we were in an old bull market or a new bull market.

To sum up the arguments, they went like this:

Old bull ? In order for a bull to become a bear, the market has to drop 20% on a closing basis. The largest decline (on a closing basis) since the bull started in March 2009 was 19.4%. Therefore, the bull is still in effect.

New bull ? On October 3, the market was down 20% from the highs on an intraday basis (though it didn?t close that low). Additionally, over the past six months, small cap stocks have outperformed large caps. That is typical behavior of new bull markets.

I say it?s all bull.

Not that I don?t believe we?re in a bull market. I do?

It?s just that I don?t really care whether we?re in a new or old bull market. It?s not going to impact my investing decisions or recommendations.

In my active trading services, I?m going to react to the market that?s right in front of me. I?m not going to try to figure out if we have a few months or a few years of the bull ahead.

It is incredibly difficult to time the stock market. Even those ?experts? who made great calls right before the markets tanked haven?t been able to duplicate their previous success. When was the last time you heard from any of the prophets who correctly called the ?87 crash?

Trying to time the market, particularly with your long-term portfolio is a fool?s game. Instead, here is a time tested (yet underappreciated) method for riding out volatile markets.

Look for stocks that are what I call ?Perpetual Dividend Raisers?. These are stocks that have a track record of raising the dividend every year. For most stocks, that will keep ahead of inflation and the high yield will provide a buffer in a market downturn.

For example, let?s say you?re invested in Darden (NYSE: DRI), the operator of Olive Garden, Red Lobster and LongHorn Steakhouse restaurants. It currently pays a 3.4% dividend yield. Darden has raised the dividend every year for seven years. Over the past five years the average raise was 28% per year.

If the company?s dividend growth rate slows down to 14% per year, the yield would still climb to 5.6% in five years and swell to 10.7% in ten years.

And if you don?t need the income today and can reinvest those dividends, the numbers get even more impressive. Assuming the stock performs according to the historical average of the stock market, your yield would grow to 6.5% in year five and 15.9% after a decade. Even more impressive is that your compounded annual growth rate would be 11.5% after five years and 12.2% after ten.

But what if one of these market prophets calls for the end of the bull market and is right? What happens to your Darden shares then?

As long as the company continues to raise the dividend, the yield numbers mentioned above will stay the same. And there?s no reason to think they can?t do it. Darden even raised the dividend significantly during the Great Recession of 2008 ? 2009.

If the stock market experiences a protracted bear market, you can still make a lot of money on your Darden stock by reinvesting the dividends.

As the market falls, reinvested dividends buy more stock. So if the market fell 5% per year every year and you had invested $10,000 in Darden, you?d be down about $100 after five years (not bad considering the overall market would be down by 25%. However, after ten years, you?d be up over $4,000 because of the power of compounding dividends, particularly when shares are cheap.

So for an investor who is reinvesting dividends, as long as they don?t need to sell anytime soon, a bear market is actually their best friend.

Owning Perpetual Dividend Raisers and especially reinvesting those dividends allows you to ignore all of the chatter about bulls and bears as your portfolio will grow no matter which creature is in control of the market.

Now, the company has created Scout for Apps and made the service available to all developers who want it, assuming they're coding iOS or HTML5 applications (Android support is in the works, and is slated to arrive later this year). That means that apps and websites can now incorporate turn-by-turn navigation directly, as opposed to launching a separate application to get you where you want to go. Keep in mind that Telenav isn't pitching this as a full GPS replacement -- more a value added proposition to developers -- and after spending some time using Scout, we can see why.

We tested the browser-based Scout service on our Android handset to run a few errands, and we found it a useful tool, but it certainly pales in comparison to its application counterparts. There's noticeable lag when attempting to swipe around maps, no pinch to zoom (onscreen buttons are the only option), and it lacks features like traffic reports or a way to remember favorite locations. That said, it does do a good job of getting you where you want to go, and the rudimentary nav functionality is certainly more appealing than the static maps found in apps currently. (AP) ? Hollywood icon James Cameron has made it to Earth's deepest point.

The director of "Titanic," ''Avatar" and other films used a specially designed submarine to dive nearly seven miles, completing his journey a little before 8 a.m. Monday local time, according to Stephanie Montgomery of the National Geographic Society.

He plans to spend about six hours exploring and filming the Mariana Trench, about 200 miles southwest of the Pacific island of Guam.

"All systems OK," were Cameron's first words upon reaching the bottom, according to a statement. His arrival at a depth of 35,756 feet came early Sunday evening on the U.S. East Coast, after a descent that took more than two hours.

The scale of the trench is hard to grasp ? it's 120 times larger than the Grand Canyon and more than a mile deeper than Mount Everest is tall.

Cameron made the dive aboard his 12-ton, lime-green sub called "Deepsea Challenger." He planned to collect samples for biologists and geologists to study.

"It's really the first time that human eyes have had an opportunity to gaze upon what is a very alien landscape," said Terry Garcia, the National Geographic Society's executive VP for mission programs, via phone from Pitlochry, Scotland.

The first and only time anyone dove to these depths was in 1960. Swiss engineer Jacques Piccard and U.S. Navy Capt. Don Walsh took nearly five hours to reach the bottom and stayed just 20 minutes. They had little to report on what they saw, however, because their submarine kicked up so much sand from the ocean floor.

"He is going to be seeing something that none of us have ever seen before. He is going to be opening new worlds to scientists," Garcia said.

One of the risks of a dive so deep is extreme water pressure. At 6.8 miles below the surface, the pressure is the equivalent of three SUVs sitting on your toe.

Cameron told The Associated Press in an interview after a 5.1 mile-deep practice run near Papua New Guinea earlier this month that the pressure "is in the back of your mind." The submarine would implode in an instant if it leaked, he said.

But while he was a little apprehensive beforehand, he wasn't scared or nervous while underwater.

"When you are actually on the dive you have to trust the engineering was done right," he said.

The film director has been an oceanography enthusiast since childhood and has made 72 deep-sea submersible dives. Thirty-three of those dives have been to the wreckage of the Titanic, the subject of his 1997 hit film.

?? LOUISVILLE, Ky. (AP) -- Harold Workman, whose job status as president of the Kentucky Fair Board has been in question, has announced he is retiring at the end of the year.

?? Workman has been involved in controversies recently over the firing of the general manager of the KFC Yum Center and reports that he had fallen into disfavor among some board members.

?? The Courier-Journal (http://cjky.it/GGbWMT) reports the board also suffered a revenue drop in recent years with the razing of the Executive Inn, closure of Kentucky Kingdom and move of the University of Louisville basketball teams from Freedom Hall to the Yum Center.

?? Workman, fair board president and CEO since 1993, makes $249,260 a year, according to a state database. His contract was set to expire at the end of June.

Store covers up pregnant Simpson on magazine cover

(AP) ? A pregnant Jessica Simpson on the cover of Elle magazine was apparently too much for some customers of a Tucson Safeway who prompted management to cover it with cardboard.

The April edition features the photo of the singer/actress/fashion designer on its cover with one hand covering an exposed breast and another wrapped around her nude belly.

A spokeswoman for Safeway tells the Arizona Daily Star (http://bit.ly/GTmMgt ) the manager of the store on East Tanque Verde Road near Catalina Highway received "multiple complaints," so the image was covered with cardboard to block any parts that might be offensive.

The Star reports a walk through the store Thursday afternoon didn't reveal any bits of cardboard shrouding Simpson's image. However, the magazines had been turned around.

Syria rebels quit eastern city; Russia critical

BEIRUT (Reuters) - Rebel fighters fled the eastern Syrian city of Deir al-Zor on Tuesday in the face of a fierce army assault, as Russia issued its toughest criticism yet of President Bashar al-Assad's handling of the year-long revolt.

The flight from the remote desert city, which lies on the road to Iraq, marked the latest setback for the armed opposition, which also faced accusations of torture and brutality from a leading human rights body.

However, just as he was making advances on the ground, Assad also appeared to suffer a setback on the diplomatic front, with key-ally Moscow adopting a new, sharper tone after months of publicly standing by his government.

"We believe the Syrian leadership reacted wrongly to the first appearance of peaceful protests and ... is making very many mistakes," Foreign Minister Sergei Lavrov told Russian radio station Kommersant-FM.

"This, unfortunately, has in many ways led the conflict to reach such a severe stage."

Lavrov also spoke of a "future transition" period for Syria but continued to reject calls from most Western and Arab states for Assad to resign, saying this was "unrealistic".

It was not immediately clear if the change in language would translate into a tangible difference in the way international powers, hitherto divided on Syria, might deal with the crisis.

The uprising started with non-violent demonstrations last March, but the situation deteriorated rapidly amid a ferocious army crackdown and there are now daily clashes between rebels and security forces around the country.

The United Nations says more than 8,000 people have been killed so far, but the toll is rising rapidly, with at least 31 men, women and children dying on Tuesday, the British-based Syrian Observatory for Human Rights reported.

The majority of the deaths, 21 in total, were in the central Homs province due to heavy army shelling. Government troops also pounded residential areas in the city of Hama and the town of Rastan, while a soldier died in a raid on a checkpoint in the south, opposition sources said.

CIVIL WAR FEARS

Lightly armed rebel forces have been forced into retreat across the country in recent weeks, with the army using heavy weapons to chase them from towns and cities, chalking up its latest victory in Deir al-Zor.

"Tanks entered residential neighborhoods, especially in southeastern areas of Deir al-Zor. The Free Syrian Army pulled out to avoid a civilian massacre," a statement by the Deir al-Zor Revolution Committees Union said.

After failing to hold significant stretches of land, analysts say the rebels appear to be switching to insurgency tactics, pointing to bloody car bomb attacks in two major Syrian cities at the weekend and the sabotage of a major rail link.

Diplomats warn the fighting could develop into a civil war pitching Assad's Alawite sect and its minority allies against the majority Sunni Muslim population.

The government says 2,000 members of the security forces have been killed by foreign-backed "terrorists" and denies accusations of brutality and indiscriminate violence.

In a new twist, the advocacy group Human Rights Watch said the rebels were guilty of serious crimes, citing cases of kidnapping, torture and cold-blooded killings.

"The Syrian government's brutal tactics cannot justify abuses by armed opposition groups," said Sarah Leah Whitson, Middle East director at the New York-based Human Rights Watch, in an open letter to dissident groups.

Washington said it would "absolutely denounce" human rights violations by the rebels, but stressed that most of the abuse was being carried out by pro-Assad forces.

RUSSIAN CONDITIONS

Russia has previously vetoed two Western and Arab-backed U.N resolutions condemning government violence, arguing that the actions of rebels should also be criticized.

In a fresh effort to form a united international front, France has circulated a Western-drafted statement for the U.N. Security Council deploring the turmoil and backing peace efforts by U.N.-Arab League envoy Kofi Annan.

Russia announced it would back the text on two conditions - that there was no ultimatum imposed on Assad and that Annan release full details of his peace plan.

Annan dispatched a team of five experts to Damascus on Monday to discuss ways of implementing the peace drive, including a mechanism to let international monitors into the country. Syria has questioned the value of such a mission and talks continue.

Lavrov also dismissed media reports of Russian warships entering Russia's naval facility in the Syrian port of Tartous as "fairy tales". Some reports had said Russian ships were delivering weapons or special forces troops.

Lavrov said a Russian tanker with fuel for Russian warships involved in anti-piracy operations in the Gulf of Aden was docked at the port. Russia has repeatedly said its arms sales to Syria violate no laws and it sees no grounds to suspend them.

The Free Syria Army, a disparate group of fighters led by army deserters, has proved little match for Assad's well-armed security apparatus, and experts said the opposition appeared to be changing tactics.

Car bomb attacks in the capital Damascus and second city Aleppo killed at least 30 over the weekend, while rebels also destroyed a railway bridge linking Damascus to Deraa, according to official Syrian media.

"The Syrian opposition prematurely tried to hold territory and take on the Syrian Army. This was a bad and costly mistake," said Joshua Landis, the head of Middle East Studies at the U.S. University of Oklahoma.

"In the new phase of the battle that is shaping up to combat the Assad regime, opposition leaders are likely to champion new tactics of militancy and Islamization," he wrote on his blog Syria Comment.
